Hyzl Terms of Service
Effective date: September 10, 2026
These Terms of Service (the "Terms") are an agreement between you and Atllas, Inc., a Delaware corporation ("Hyzl", "we", "us") governing your use of Hyzl, our paywall recovery service for iOS and web subscription apps.
"You" means the business that signs up for Hyzl — the merchant. Hyzl is a tool for businesses, not a consumer product.
By creating an account, connecting a billing provider, or sending us an event, you agree to these Terms. If you are agreeing for a company, you confirm you have authority to bind it.
1. What Hyzl does
You connect your app to Hyzl. When one of your users opens your paywall and leaves without paying, your app or server sends us an event containing the user's phone number, a stable identifier you assign, optionally their email and first name, and a flag telling us the user consented to be texted.
We wait. Before sending anything, we check your billing provider to confirm the user still has not paid. If they have not, we send a text from a phone number we provision for your app, presented as your app's AI representative, powered by Hyzl.
Your user can text that number back or call it. An AI model writes the replies and answers the calls. Follow-up texts stop when the user pays, replies STOP or a similar opt-out word, or the sequence finishes — at most four texts over a few days. We do not place outbound calls.
You can watch every conversation in your dashboard and take over at any time to reply as a human.
We may change how the service works, but we will not silently expand what we do with your users' data beyond what these Terms and the Privacy Policy describe.
2. Your account
Keep your credentials and API keys secret. You are responsible for everything that happens under your account, including what your employees and contractors do. Tell us promptly at support@hyzl.app if you think someone else has gained access.
You must be at least 18 and able to enter into a contract. Hyzl is not offered to individuals for personal use.
3. Consent is your responsibility
This is the most important section in this agreement. Read it carefully.
You are the sender. The texts Hyzl sends go to your customers, about your app, with your brand on them. We are the tool you send them with. You are responsible for having the legal right to text each person whose number you give us.
Before you send us a phone number, you must have obtained that person's prior express written consent to receive automated marketing text messages from your app, in the form U.S. law requires. In practice that means:
- A clear, conspicuous disclosure where the user gives you their number, stating that they agree to receive automated marketing texts and that consent is not a condition of purchase.
- An affirmative action by the user — a box they checked themselves, or a tap on a button whose label says what they are agreeing to. Not a pre-ticked box, not buried in a wall of text.
- A record of that consent: what the user saw, when they agreed, from what device or session. Keep it.
- The disclosures the CTIA Messaging Principles and Best Practices require: message frequency ("Msg frequency varies"), that message and data rates may apply, "Reply STOP to opt out", "Reply HELP for help", and links to your terms and privacy policy.
Send us the consent flag honestly — if it says a user consented, we treat that as true. Do not send a number for a user who did not consent, whose consent expired or was revoked, who is on your do-not-contact list, or whose consent you cannot document.
You also warrant the accuracy of what you send. Numbers must belong to the user you say they belong to, and identifiers must be stable and never reused across people. Send a wrong number and a stranger gets a text about an app they have never used — a problem you created.
You are responsible for complying with the Telephone Consumer Protection Act, state telemarketing and automated-message laws, carrier rules, the CTIA guidelines, and the app store rules you distribute under. Stricter local rules apply where they exist.
4. What we do to help
We are not neutral about compliance. The guardrails are built in and not optional:
- STOP is absolute. When a user replies STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, or anything we reasonably read as an opt-out, we stop immediately and permanently for that number across your account. One confirmation, then nothing. You cannot override this, and re-uploading the number will not restart it.
- Quiet hours. We send no earlier than 8:00 a.m. and no later than 9:00 p.m. in the recipient's time zone, tighter where local law requires. Sends that fall in quiet hours are held until the window opens.
- Frequency caps. At most four messages over a few days. We do not restart a finished sequence without a new paywall event and a fresh consent flag.
- Payment check. We re-check your billing provider before each message and stop when the user pays.
- HELP. We answer HELP with your app name, our identity as the AI rep, and opt-out instructions.
These limits protect your users, your number's deliverability, and you. We will not disable them on request.
5. AI disclosure
The replies Hyzl sends and the calls it answers are generated by an AI model. We currently use xAI's Grok models.
Messages identify themselves as coming from your app's AI representative, powered by Hyzl, and if a user asks whether they are talking to a person, the AI will say it is not. Do not ask us to remove that disclosure, and do not claim a human wrote something an AI wrote.
AI output is probabilistic. It can be wrong, and it can misstate a price, a feature, or a policy. Review the conversations in your dashboard, and take over as a human for anything that matters — billing disputes, refunds, complaints, legal threats, or anyone in distress. We give you tools to configure what the AI should and should not say about your app. Use them and keep them current.
We are not responsible for the substance of AI-generated statements about your app, pricing, or policies. You are. See sections 11 and 12.
6. Connecting your billing provider
Hyzl connects to RevenueCat or Stripe through read-only OAuth and reads customers, subscriptions, and revenue metrics, so we can confirm whether a user has paid and show you what recovery produced.
We never charge, refund, cancel, or modify anything in your billing account. Access is read-only and we intend to keep it that way. Revoke it any time from your billing provider or dashboard. Without it we cannot confirm payment, so we stop sequences rather than text someone who may have already paid.
7. The phone number
We provision a phone number for your app through our telephony provider. It is licensed to you for use with Hyzl during your subscription. You do not own it and cannot port it away unless we agree in writing.
We register the number for A2P 10DLC messaging, which requires accurate business information from you — legal entity name, address, tax ID, use case, sample messages. Carriers can reject, throttle, or suspend a number based on complaint rates and content. We will tell you if that happens, but we do not control carrier decisions and are not liable for carrier-level filtering or blocking.
If your complaint rate, opt-out rate, or content puts the number or our platform at risk, we may pause your sending until you fix it.
8. Fees
Pricing is $1 per person per 30-day period. A "person" is a unique end user we message on your behalf in that period. The first 50 people per app are free, and there is a $100 monthly minimum once you are past the free tier. You set a spending cap in the dashboard; we stop initiating new sequences when you reach it.
Billing runs by card through Stripe, and you authorize us to charge your card on file as fees accrue. Fees exclude taxes; you are responsible for any sales, use, or VAT taxes other than taxes on our income.
Fees are non-refundable except where the law requires. If a charge fails, we may suspend the service until it clears. We can change pricing with at least 30 days' notice; cancel before it takes effect if you do not agree.
Billing is not yet live as of these Terms. Until we turn it on and tell you in writing, the service is free, and nothing here obliges you to pay for a period before billing begins.
9. Acceptable use
Do not use Hyzl to:
- Text anyone who did not give you documented consent, or anyone who opted out.
- Promote anything carriers prohibit — cannabis, firearms, gambling, high-risk financial products, adult content — or anything illegal.
- Impersonate another business, or present Hyzl's messages as coming from someone other than your app.
- Harass, threaten, or pressure users, or dispute an opt-out.
- Message anyone you know or reasonably should know is under 18.
- Reverse engineer, scrape, or resell the service, or use it to build a competing product.
- Send us data we do not need — health records, government identifiers, card numbers, or precise location.
We can suspend or terminate an account that violates this section, without notice where the violation creates legal or carrier risk.
10. Data, privacy, and your users
Our Privacy Policy explains what we collect and why. It is part of these Terms.
For the personal data you send us about your users, you are the controller (or business) and we are the processor (or service provider). We process it only to provide the service to you. We do not sell it, and we do not use it to train AI models for anyone else.
We retain end user data for 12 months by default, and delete it sooner if you or the end user asks. We keep one thing permanently — a hashed number on a do-not-contact list — because deleting it would let an opted-out person be texted again.
A data processing addendum is available at support@hyzl.app. If you are subject to the GDPR, the UK GDPR, or the CCPA, sign it.
You own your data and can export conversations and results from the dashboard while your account is active.
11. Your indemnity
You will defend, indemnify, and hold harmless Hyzl, Atllas, Inc., and our officers, employees, and agents from any claim, penalty, fine, loss, or expense, including reasonable attorneys' fees, arising out of:
- Your failure to obtain, document, or honor valid consent to text a person.
- Any claim under the TCPA, a state telemarketing statute, or a similar law relating to messages sent on your behalf.
- Inaccurate, outdated, or wrong-person data you sent us.
- Your app, pricing, policies, or statements about them.
- Your breach of these Terms or of applicable law.
This is not a formality. TCPA claims carry statutory damages per message, and class actions are common. If you cut corners on consent, the exposure is yours.
We will notify you of any claim we tender, and you may control the defense with counsel we reasonably approve. You may not settle in a way that admits our fault or imposes obligations on us without our consent.
12. Disclaimers
The service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not promise that Hyzl will recover any particular number of subscriptions, any amount of revenue, or any result at all. We do not promise uninterrupted or error-free operation, carrier delivery, or accurate AI output.
We are not your lawyer. Nothing in the product, the dashboard, our templates, or our documentation is legal advice — about consent, the TCPA, or anything else. Get your own counsel.
13. Limitation of liability
To the fullest extent permitted by law:
Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business interruption, even if advised of the possibility.
Our total aggregate liability for all claims relating to these Terms or the service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) [one hundred dollars ($100)].
These limits do not apply to your payment obligations, your indemnity in section 11, or liability that cannot be limited by law.
14. Term, suspension, and termination
These Terms run until you or we terminate. Cancel any time from the dashboard; cancellation takes effect at the end of your current billing period, and we do not refund the remainder.
We can suspend immediately for non-payment, for a violation of section 9, or where continued sending creates legal or carrier risk, and we can terminate for convenience with 30 days' notice.
On termination: your access ends, we release the phone number, we stop all in-flight sequences, and we delete or de-identify your end user data within 90 days, except do-not-contact records and anything the law requires us to keep. Sections 8 (accrued fees), 10, 11, 12, 13, 15, and 16 survive.
15. Governing law and disputes
These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules. The state and federal courts in Delaware have exclusive jurisdiction, and both parties consent to venue there.

16. General
Changes. We can change these Terms. For material changes we will give at least 30 days' notice by email to your account address and in the dashboard. Keep using Hyzl after a change takes effect and you accept it; otherwise cancel before then.
Assignment. You may not assign these Terms without our written consent, except to a successor in a merger or sale of substantially all your assets. We may assign freely.
Force majeure. Neither party is liable for delays caused by events outside its reasonable control, including carrier outages, provider failures, and acts of government.
Entire agreement. These Terms, the Privacy Policy, and any order form or DPA you sign are the whole agreement on this subject and replace anything said before.
Severability and waiver. If a provision is unenforceable, the rest stays in force. Not enforcing a right once does not waive it.
Relationship. We are independent contractors. Nothing here creates a partnership, joint venture, or employment relationship.
